Nigeria – Yahaya Bello, the former governor of Kogi State, is facing a 19-count charge linked to allegations of money laundering and criminal breach of trust under Nigeria’s Money Laundering (Prohibition) Act, 2011.

During the latest court session on December 13, 2024, Bello, through his legal representative, expressed regret for his previous absences, which had delayed trial proceedings.

Speaking in court, Bello’s attorney, J.B. Daudu SAN, apologized for any perceived disrespect caused by his client’s prior non-attendance. He clarified that the absences stemmed from procedural decisions rather than an intention to disregard the court. “My lord, I am apologizing on behalf of the defendant for any perceived disrespect towards the court in the past,” Daudu stated.

He assured Justice Emeka Nwite of the Federal High Court in Abuja that his client would be present at all future trial dates barring health or other critical emergencies.

EFCC Pursues Justice in High-Profile Case

The Economic and Financial Crimes Commission (EFCC) has accused Bello of conspiring to convert ₦80.2 billion—funds believed to be derived from unlawful activities. According to EFCC spokesperson Dele Oyewale, Bello reportedly orchestrated fraudulent transactions through various businesses between 2016 and 2023.

Despite these serious allegations, Bello pleaded not guilty to all charges. His legal team described the earlier jurisdictional challenges as procedural maneuvers, maintaining their client’s respect for the judiciary.

Bail Conditions and Judicial Proceedings

In a show of leniency influenced by the defense’s professional conduct, Justice Nwite granted Bello bail of ₦500 million with strict conditions. The bail terms include two sureties with properties located within the court’s jurisdiction, submission of Bello’s international passport, and a sworn oath of means.

Justice Nwite emphasized the importance of his independence in the ruling. “Neither side will give me instructions. However, I lean towards granting bail in light of J.B. Daudu SAN’s guarantees,” he noted, while cautioning that the absence of such assurances could have led to a different outcome.

Legal Representatives Stress Professionalism

Dr. Kemi Pinheiro SAN, representing the EFCC, commended Daudu’s professionalism throughout the case. “J.B. Daudu SAN’s integrity must be acknowledged. Our goal has been to make the process more efficient and less taxing on your Lordship,” Pinheiro remarked. He also highlighted the EFCC’s role as a professional agency dedicated to justice.

The trial has been adjourned to February 24 and 28, as well as March 6 and 7, 2025, with Justice Nwite reiterating the court’s commitment to an impartial and efficient process.
